Welcome to CURATE. These Terms of Service (“Terms”) govern your use of our website and your purchases from CURATE (“we,” “us,” or “our”). Our store is powered by Shopify. By using our website or placing an order, you agree to these Terms and our Privacy Policy.

1. Our products

CURATE offers a mix of antique, vintage, one-of-a-kind, and other selected pieces. Antique and vintage items may show wear, repairs, patina, or other signs of age. Variations in color, design, and finish are part of what makes many pieces unique.

Please review each item’s photos, description, dimensions, and condition details before purchasing. Screen settings and lighting may affect how colors appear. If you would like more information about a piece, email Info@shopcurate.store before placing your order. We aim to describe our products accurately and may correct an error or update a listing when needed.

2. Orders and payment

Placing an order is an offer to purchase. We may decline or cancel an order if an item is unavailable, a listing or pricing error has occurred, payment cannot be processed, or we reasonably suspect fraud. If we cancel an order after payment, we will refund the amount paid for the canceled item.

Please check your order, shipping address, and contact information before submitting it. Orders cannot ordinarily be changed or canceled after submission, subject to any rights provided by applicable law.

Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and any other charges shown at checkout will be added to your order. Prices and availability may change, but a later price change will not alter an order we have already accepted.

3. Final sales and returns

All sales are final. We do not accept returns or exchanges for a change of mind. If an item arrives damaged or differs materially from its description, contact us promptly at Info@shopcurate.store with your order number and photos of the item and packaging.

If we approve a return as a courtesy, return shipping and a restocking fee may apply. We will tell you any applicable charges before you send the item back. Please read our full Returns & Exchanges Policy. Nothing in these Terms limits rights you may have under applicable law.

4. Shipping and delivery

Shipping options, charges, and any available delivery estimates are provided during checkout or in our Shipping Policy. Delivery estimates are not guarantees. If we cannot ship an online order within the promised time, we will contact you and handle the delay or cancellation as required by applicable law.

Please inspect shipped items when they arrive. If a package or item appears damaged, photograph the item and packaging and email us promptly at Info@shopcurate.store. We ask that you report shipping damage within 48 hours when possible so we can investigate it quickly.

5. Website use and accounts

You agree to provide accurate information when placing an order or creating an account. You are responsible for keeping your account credentials secure and for activity under your account. You may use our website only for lawful purposes and may not interfere with its operation, security, or other customers’ use.

6. Content and intellectual property

Our website’s original text, photography, graphics, branding, and design belong to CURATE or their respective owners and are protected by applicable intellectual property laws. You may browse the website for personal or legitimate business purchasing purposes. You may not copy or use its content for another purpose without permission.

7. Third-party services and links

Our website may include links to other websites or features provided by third parties. Their services and policies are their own. Please review their terms before using them.

8. Relationship with Shopify

CURATE is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with CURATE. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and CURATE, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with CURATE.

10. Reviews and feedback

If you submit a review, photograph, or other feedback to CURATE, you confirm that you have the right to share it. You give us permission to display and use that feedback in connection with our store and marketing. We may remove content that is unlawful, misleading, offensive, or infringes another person’s rights.

11. Errors and availability

Occasionally, a listing may contain an error concerning price, description, shipping, or availability. We may correct the error and, where necessary, cancel an affected order and refund the amount paid for the canceled item.

12. Warranties and liability

Antique and vintage items are sold in their disclosed condition, including the age-related characteristics described in their listings. To the extent permitted by law, our website and products are provided without additional warranties beyond those expressly stated by CURATE. We do not guarantee uninterrupted or error-free access to the website.

To the extent permitted by law, CURATE is not responsible for indirect or consequential losses arising from your use of the website or a purchase. Nothing in these Terms excludes responsibility or customer rights that cannot legally be excluded.

13. Changes to these Terms

We may update these Terms by posting a revised version on this page. The version in effect when you place an order will apply to that order, unless applicable law requires otherwise.

14. Governing law

These Terms are governed by the laws of the State of Texas, except where applicable law requires otherwise. Any dispute concerning these Terms will be brought in an appropriate court in Harris County, Texas, unless applicable law provides otherwise.
